Malawi’s record draws attention for two reasons: it became bound by its own accession rather than by a notification of succession, and notaries public are among its certifying officers. This page is for Malawian institutions and notaries receiving Turkish papers and for Turks with Malawian documents. It covers the 1967 record, the list that includes notaries, who certifies a notarial act in Türkiye, what the HCCH record does not show and the place of translation.
Malawi in 1967: accession, not succession
Malawi’s row in the HCCH table carries A: it deposited its instrument of accession on 24 February 1967, and the Convention began to operate for it on 2 December 1967. Unlike the succession records marked “Su”, there is no backdated date here; effect follows accession. When Türkiye became bound on 29 September 1985, Malawi was already on record; the relationship began that day and no objection is recorded between the two. Malawi is not among the Members of the Hague Conference.
Notaries on the list: what sets Malawi’s entry apart
The HCCH authority page includes notaries public among Malawi’s certifying officers. That item separates Malawi from systems in which only ministries or courts certify. Which notaries may certify which documents, and under what conditions, is not stated in the HCCH summary and was not verified here. A Malawian certificate issued by a notary public comes from a category of authority notified to the HCCH. Under article 5 the certificate confirms the signature on the document, the capacity of the signer and the seal or stamp.
From the Registrar General to Government Agents: other Malawian officers
The rest of the list consists of titles: the Attorney General or Solicitor General, Permanent Secretaries, the Registrar of the High Court, the Registrar General, Government Agents and Resident Magistrates. Titles of persons are given instead of institutions, and no allocation by document type appears in the HCCH summary. The authority page shows no update date, so whether the list is still the same cannot be read from the record. No fee is given either.
In Türkiye, a governor certifies the notarial act
In Malawi a notary may be a certifying officer; in Türkiye the position differs. Türkiye’s HCCH entry names governors, district governors, the Chief Secretary and the judicial commission presidencies; notaries are not on it. When a Malawian authority wants an apostille on a Turkish notarial document, a notarised translation or a power of attorney for example, a valilik or kaymakamlık, the provincial or district governor’s office, places it, and since 30 November 2024 that can be done in any province or district (Notaries Law, article 199). According to the Onikişubat district governor’s office, the apostille on a notarised translation confirms the notarial certification, not the content of the translation. Administrative documents are also certified at a valilik or kaymakamlık, and the original of a court judgment by the adalet komisyonu başkanlığı at a high criminal court seat. An apostilled document for Malawi needs no further legalisation at the Turkish Ministry of Foreign Affairs.
What the Malawian record does not show, and translation
The e-APP chart of 13 August 2026 has no electronic apostille or online register for Malawi; how to check a Malawian certificate was not found in this site’s survey. Malawi has not acceded to ETS 063, CIEC 16 or CIEC 17. Which language and certification Malawian institutions want on a translation of a Turkish document was not found either; the receiving institution sets it. When a Malawian notarial document is translated into Turkish, the receiving Turkish institution decides whether the notary public’s certificate is translated too. Open points: the limits of notaries’ certifying power, allocation among titles, whether the list is current, the fee and the verification route. A translation office renders the text and does not judge whether a Malawian certificate suffices.
